Los productos y servicios en adelante denominados los "Servicios" se proporcionan a través de DESARROLLOS Y SISTEMAS MCG S.A. en adelante denominada "wstudio.app".
El uso de nuestros Servicios implica la aceptación de estas condiciones. Por favor, lea y revise atentamente los Términos y Condiciones de uso y nuestra Política de Privacidad antes de utilizar cualquier Servicio de wstudio.app. De no estar de acuerdo con estas condiciones, por favor no continúe con utilizando nuestros Servicios.
wstudio.app brinda distintos Servicios a personas físicas y/o jurídicas, en adelante denominadas “Usuario”, por Usuario deberá entenderse cualquier persona que emplea los servicios o productos de wstudio.app.
Las presentes condiciones regulan el acceso o uso que los Usuarios hagan a Servicios que wstudio.app pone a disposición. Al utilizar los Servicios, usted acepta en su totalidad y se obliga a cumplir por completo los Términos y Condiciones de Uso, así como nuestra Política de Privacidad. wstudio.app se reserva el derecho a modificar estos Términos y Condiciones de Uso cuando lo estime necesario. Por lo tanto, el Usuario debe leer atentamente los Términos y Condiciones de Uso en cada una de las ocasiones en que se proponga utilizar el Servicio, ya que estos pueden sufrir modificaciones.
Estos Términos y Condiciones de Uso serán aplicables a todas las marcas, los productos y los servicios de wstudio.app que no disponen de términos y condiciones de uso independiente. Estos Términos de Uso se limitan solamente a wstudio.app y sus Servicios. wstudio.app no controla y no puede controlar y/o garantizar los Términos de Uso o la Política de Privacidad de terceros, incluyendo proveedores y/o compañías a las que pueda tener acceso a través de nuestros servicios.
El Usuario se compromete a no usar los Servicios con fines fraudulentos así como a no llevar a cabo conducta alguna que pudiera dañar la imagen, los intereses y los derechos de wstudio.app o de terceros. Asimismo, el Usuario se compromete a no realizar acto alguno con objeto de dañar, inutilizar o sobrecargar cualquier Servicio, realizar ingeniería inversa o que impidiera de cualquier forma la normal utilización y funcionamiento del mismo.
Se informa al Usuario de que en el caso de que incumpla el contenido de los presentes términos de uso y condiciones, de la Política de Privacidad o de cualesquiera otros términos o condiciones particulares establecidos en los Servicios, wstudio.app se reserva el derecho a limitar, suspender, interrumpir o terminar su acceso a los Servicios. Asimismo, wstudio.app se reserva la posibilidad de ejercer tales medidas en el supuesto que sospeche razonablemente, que el Usuario está vulnerando cualquiera de los términos y condiciones antes citados. Finalmente, ponemos en conocimiento del Usuario que wstudio.app se reserva en todo momento, la facultad de decidir sobre la continuidad de los Servicios que presta, por lo que es decisión de wstudio.app mantener o finalizar los Servicios.
wstudio.app es el proveedor de varios Servicios, tales como pero no limitados a proporcionar una herramienta de administración de estudios de fitness, yoga y demás, manejo de reservaciones, mensajería, clientes, fechas de vencimiento, calendario. En aquellos casos en los que el Usuario así lo haya consentido, podrá el Usuario recibir información y noticias de wstudio.app o relacionados con la salud y el deporte mediante correo electrónico, SMS u otros medios de comunicación electrónica. Se le recuerda que con el uso del Servicio, se entiende su aceptación inmediata al recibo de todo tipo de información comercial o publicitaria por parte de wstudio.app.
Algunos de nuestros Servicios permiten subir, enviar, almacenar o recibir contenido. Si lo hace, seguirá siendo el titular de los derechos de propiedad intelectual y/o personal que tenga sobre ese contenido. No obstante, en algunas ocasiones wstudio.app, sus directores, subsidiarias, representantes, socios y/o colaboradores podrán usar, alojar, almacenar, reproducir, modificar, crear, comunicar, ejecutar o mostrar dicho contenido siempre y cuando se cuente con su consentimiento. Asegúrese de tener los derechos necesarios sobre cualquier contenido que envíe a nuestros Servicios, en caso de utilizar información incompleta o que no le pertenece se hará bajo su total responsabilidad, por lo que wstudio.app no se hace responsable por la información que el Usuario decida incluir y/o cualquier uso que se le dé.
Esta cláusula aplica solamente para estudios que contratan un producto o Servicio de wstudio.app.
El Usuario deberá pagar el Servicio por adelantado, según el plan que haya seleccionado y sus características específicas. Los periodos de pago son únicamente mensuales. El Usuario es responsable de proveer la información de pago completa, actualizada y exacta, junto con sus datos de contacto, y notificar cualquier cambio a wstudio.app. La factura se enviará automáticamente al correo electrónico que el Usuario indique. Al realizar el pago, el Usuario acepta y autoriza el recibo y envío de la información de cobro correspondiente a su servicio.
Los métodos de pago aceptados por wstudio.app son:
Los pagos con tarjeta de crédito o débito se procesan en dólares estadounidenses (USD). Los pagos realizados mediante SINPE Móvil o transferencia bancaria pueden efectuarse en colones costarricenses (CRC) o en dólares (USD), según la cuenta bancaria indicada por wstudio.app.
Si el Usuario realiza el pago mediante transferencia o SINPE Móvil, deberá efectuar el pago con al menos tres (3) días de anticipación a la fecha de cobro. Además, el Usuario debe reportar el pago en la pantalla correspondiente dentro del sistema de wstudio.app. No basta con realizar la transferencia sin reportarla; los pagos no reportados se considerarán como no realizados.
En caso de no reportar el pago o hacerlo fuera del plazo establecido, se cobrará una multa de $10 USD por pago tardio.
wstudio.app no almacena información de las tarjetas utilizadas para realizar pagos. Los datos viajan de forma segura directamente hacia la entidad bancaria procesadora y no se guardan en nuestros servidores.
Los honorarios de wstudio.app no incluyen impuestos de ningún tipo. El Usuario es el único responsable del pago de cualquier impuesto asociado con la compra del Servicio. wstudio.app es únicamente responsable por los impuestos derivados de sus propios ingresos, propiedad y empleados.
wstudio.app se reserva el derecho de suspender, bloquear o terminar el Servicio si el Usuario no realiza el pago correspondiente en la fecha indicada o no reporta correctamente una transferencia. Antes de la suspensión, wstudio.app realizará esfuerzos razonables para notificar al Usuario por medio de la plataforma. Si no se regulariza el pago, wstudio.app no se hace responsable por la pérdida de información, ya que el impago implica que el Usuario no desea continuar con los Servicios.
El servicio se paga de forma mensual y por adelantado. wstudio.app no realiza reembolsos ni devoluciones de dinero, ni por fracciones de periodo. Si el Usuario cancela o desactiva su cuenta antes de finalizar el periodo, mantendrá acceso hasta la finalización del mismo. Se recomienda revisar cuidadosamente el plan antes de realizar el pago.
Dado que el servicio se paga por periodos correspondientes de forma mensual por adelantado, se le recomienda revisar el tipo de plan de que desea adquirir, lo anterior en virtud de que wstudio.app no hace reembolsos ni devoluciones de dinero. wstudio.app tampoco hace reembolsos por fracciones de periodo de pago por uso del Servicio. En el caso de que el Usuario desactive o cancele su cuenta antes de finalizar el periodo de pago, el Usuario mantendrá acceso a su cuenta durante el resto de dicho periodo por el cual había pagado.
wstudio.app cambia y mejora sus Servicios constantemente. Por ello, es posible que agreguemos o eliminemos algunas funciones, servicios o características, o que suspendamos o cancelemos un Servicio por completo.
Usted puede dejar de usar los Servicios en cualquier momento, aunque lamentaríamos que así fuera. De igual modo, wstudio.app puede dejar de proporcionar los Servicios o añadir o crear nuevas limitaciones en cualquier momento, sin que este hecho le genere ningún tipo de responsabilidad a wstudio.app.
Consideramos que usted es el propietario de sus datos y que es importante que mantenga el acceso a los mismos. Si eliminamos y/o interrumpimos un Servicio, en los casos en los que sea razonable, le notificaremos con cinco días naturales y le permitiremos obtener la información que se encuentre dentro del Servicio mediante el uso de los reportes existentes. Una vez transcurrido el plazo antes referido, wstudio.app podrá eliminar o bloquear la información. La no contestación de la comunicación enviada por wstudio.app, se entenderá como falta de interés y consentimiento expreso para borrar la información.
Los datos personales serán suministrados a wstudio.app por parte del Usuario. wstudio.app no transferirá a terceros los datos personales bajo ninguna forma, salvo que haya obtenido su consentimiento o cuando así lo exija la ley. Sin embargo, podrá utilizar los datos de carácter personal para fines internos, incluyendo auditorías, análisis de datos e investigaciones, con el fin de mejorar los productos, servicios y comunicaciones a usuarios de wstudio.app. No obstante dicho uso será disociado.
wstudio.app podrá utilizar la información que no sea personal para sus propias investigaciones y estadísticas, y podrá compartir y/o vender esta información a terceros o utilizarlas para fines de marketing o prospección comercial, el Usuario acepta que podemos proporcionar información no identificable a cualquier organización con la que wstudio.app mantenga algún tipo de relación, siempre y cuando esta información sea disociada y no identifique a ningún Usuario.
Los datos consolidados tienen la consideración de datos de carácter no personal. Si combinamos datos de carácter no personal con datos de carácter personal, los datos combinados serán tratados como datos de carácter personal en tanto sigan estando combinados.
El Usuario es responsable de mantener la confidencialidad de la contraseña y cualquier otra información de su cuenta de acceso. Es responsabilidad del Usuario el uso que dé al Servicio, al compartir toda o parte de su información con cualquier tercero. Asimismo, es responsabilidad del Usuario el compartir con terceros, su usuario de ingreso y/o contraseña que puedan tener acceso, alterar o eliminar la información almacenada en el Servicio. Del mismo modo será responsabilidad exclusiva del Usuario respaldar periódicamente la información ingresada y guardada en cualquier Servicio, lo anterior pues en caso de malfuncionamiento por causas externas a wstudio.app o mal uso de la computadora y/o de la aplicación, la información puede desaparecer. wstudio.app debe ser notificado inmediatamente a wstudio.app@gmail.com si un Usuario considera que las medidas de seguridad se han comprometido o su cuenta ha sido violada y/o alterada.
A pesar de todas las exenciones de responsabilidad en virtud del presente documento, la única y exclusiva solución para cualquier disputa con wstudio.app es la cancelación de la inscripción o terminación del Servicio. En ningún caso wstudio.app será responsable ante el Usuario de una cantidad en exceso de $100 para todas las reclamaciones y demandas de cualquier naturaleza, tipo y/o extensión, ya sea real o contingente, directa, y punitiva, incluyendo honorarios y costos de abogados. Además, en ningún caso wstudio.app será responsable por cualquier pérdida, gastos, viajes, gastos de alojamiento, lesiones, agravaciones de condiciones físicas y mentales, muerte, pérdida de información, daño a la imagen, y cualquier otro hecho causado en parte o en su totalidad por una falla de un Proveedor o del Servicio brindado por wstudio.app.
wstudio.app no se responsabiliza de los daños y perjuicios causados al Usuario como consecuencia de riesgos inherentes al medio empleado, ni de los ocasionados por las vulnerabilidades en sus sistemas y herramientas. wstudio.app no garantiza tampoco la total seguridad de sus sistemas y aunque tiene adoptadas medidas de seguridad adecuadas, no puede descartarse totalmente la existencia de vulnerabilidades y, en consecuencia, el Usuario debe ser precavido en la interacción y uso con los Servicios.
wstudio.app únicamente será responsable hasta el monto señalado en el punto 8 del presente documento de los daños causados por el uso y funcionalidad de los Servicios, cuando dichos daños sean directamente causados por dolo o negligencia grave de wstudio.app, y no hubiera mediado negligencia por parte del Usuario tal como pero no limitado a: brindar y/o compartir su clave y/o cualquier tipo de información. En particular, wstudio.app no será responsable de:
wstudio.app hace su mayor esfuerzo para resguardar su información personal, no obstante el Usuario es el responsable de realizar copias de seguridad, en su propia computadora o en otro dispositivo, de cualquier documento, imagen u otro contenido importante que guarde o al que acceda mediante los Servicios otorgados por wstudio.app. wstudio.app realizará su mayor esfuerzo para brindar los Servicios, pero no otorga ninguna garantía de que el contenido que se guarde o al que se acceda mediante los Servicios pueda resultar, en forma inadvertida dañado, pueda perderse o corromperse.
El Usuario reconoce y acepta expresamente que el uso que haga a los Servicios queda bajo su propia cuenta y riesgo, por lo que el Usuario será el único responsable de cualquier daño que se produzca en su dispositivo o de la pérdida de datos que resulte de descargar dicho material. El Usuario reconoce además que los Servicios no están destinados ni son adecuados para ser utilizados en situaciones o entornos en los que el uso del Servicio pudiera conllevar muerte, daños personales o patrimoniales, lesiones físicas graves o daños importantes al medio ambiente.
En el caso de que wstudio.app determine o sospeche razonablemente que un Usuario ha violado o podría violar las políticas de privacidad, condiciones o cualquier acuerdo, podrá, pero no está obligado a, sin previo aviso, interrumpir y/o suspender inmediatamente el registro o uso de un Usuario. wstudio.app puede de vez en cuando cancelar las cuentas debido a la inactividad prolongada; en esta circunstancia, wstudio.app se esforzará razonablemente a dar aviso a la dirección de correo electrónico que conste en nuestros registros. En ningún caso wstudio.app será obligado a tomar una medida para suspender o cancelar.
Del mismo modo si usted desea desactivar su cuenta, por favor póngase en contacto con nosotros. Una vez realizada su solicitud su cuenta será desactivada y su información personal será archivada o destruida según corresponda por ley. wstudio.app podrá guardar su información por el período que la ley le exija para cumplir con las obligaciones legales, resolver disputas y acuerdos o cualquier otro que sea requerido de conformidad con los presentes términos y condiciones y la ley vigente.
Salvo en el caso de negligencia grave o mala conducta intencional de wstudio.app debidamente comprobada, el Usuario se compromete a indemnizar y defender a wstudio.app, junto con sus oficiales, directores, empleados, agentes, representantes, empresas afiliadas o subsidiarias, y los contratistas, de todas las responsabilidades, reclamaciones, demandas y gastos, incluyendo honorarios razonables de abogados y gastos, hechos por cualquier tercero que surgen de o están relacionadas con el acceso del Usuario a los Servicios, y/o violación de las políticas de privacidad y los términos y condiciones de uso.
wstudio.app, de conformidad con la Ley de Protección de la Persona frente al Tratamiento de sus datos Personales, Ley 8968 y su Reglamento en adelante identificados como "la Ley", le informamos de la existencia de la base de datos denominada "Usuarios", cuyo responsable del uso, administración y protección de sus datos personales es wstudio.app, razón por la cual wstudio.app permanentemente buscará que el tratamiento de sus datos personales sea legítimo, controlado e informado, con la finalidad de garantizar la privacidad y el derecho a la autodeterminación informativa de sus datos.
Los datos personales que recopilamos de usted, en adelante identificado como El Usuario, a través de medios electrónicos, físicos o por vía telefónica, de manera verbal y/o escrita, los utilizaremos para los siguientes fines necesarios:
Es importante señalar, que wstudio.app no es responsable de la veracidad ni la precisión de los datos personales que usted nos proporciona, ya que los mismos no han sido previamente validados y/o verificados, por lo que es su responsabilidad la inclusión, actualización, veracidad y exactitud de sus datos personales. La entrega de la información es facultativa, sin embargo la falsedad u omisión de algún dato supondrá la imposibilidad para prestar correctamente el servicio.
wstudio.app implementará las medidas de seguridad, técnicas, administrativas y físicas, necesarias para procurar la integridad de sus datos personales y evitar su daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizado. Únicamente las empresas, el personal autorizado por wstudio.app y/o cualquiera de las empresas que formen parte del grupo de interés económico, que ha cumplido y observado los correspondientes requisitos de confidencialidad, podrá participar en el tratamiento de sus datos personales. El personal autorizado tiene prohibido permitir el acceso de personas no autorizadas y utilizar sus datos personales para fines distintos a los establecidos en el presente documento.
Usted puede revocar el presente consentimiento otorgado para el tratamiento de sus datos personales. Sin embargo, es importante que tenga en cuenta que no en todos los casos podremos atender su solicitud o concluir el uso de forma inmediata, ya que es posible que por alguna obligación legal se requiera seguir tratando sus datos personales. Asimismo, usted deberá considerar que para ciertos fines, la revocación de su consentimiento implicará la conclusión de su atención y/o servicios brindados.
Le recordamos la posibilidad que tiene de conocer de forma gratuita qué datos personales nos ha suministrado, así como de solicitar la corrección, actualización, cancelación o supresión (derechos ARCO) de su información en los términos establecidos por Ley, dirigiendo una comunicación escrita a la siguiente dirección: wstudio.app@gmail.com, indicando nombre y apellidos, domicilio, petición clara de su derecho, fecha y firma de la persona interesada.
wstudio.app ofrece integraciones opcionales con servicios de terceros, tales como Zoom, para complementar la funcionalidad ofrecida al Usuario. El uso de estas integraciones es voluntario y requiere la autorización expresa del Usuario mediante el flujo de conexión correspondiente dentro de la aplicación.
Al activar una integración, el Usuario acepta que wstudio.app acceda únicamente a la información estrictamente necesaria para prestar la funcionalidad descrita, y que dicha información sea almacenada de forma segura y asociada exclusivamente al estudio que realiza la conexión. wstudio.app no comparte esta información con terceros ni la utiliza para fines distintos a los descritos.
El Usuario podrá desactivar cualquier integración en cualquier momento desde la configuración de su estudio o desde la plataforma del servicio de terceros correspondiente. Al desactivarla, wstudio.app revocará las credenciales asociadas y dejará de utilizar dicho servicio. wstudio.app no se responsabiliza por el funcionamiento, disponibilidad o cambios en los términos del servicio de terceros, los cuales se rigen por sus propias políticas y condiciones.
wstudio.app puede modificar estas condiciones o cualquier condición adicional que se aplique a un Servicio. Recomendamos que consulte los términos y condiciones de uso de forma periódica. wstudio.app publicará avisos relacionados con las modificaciones de estas condiciones. Asimismo, publicará avisos relacionados con las modificaciones que se hagan en las condiciones adicionales de los Servicios correspondientes. Las modificaciones no se aplicarán con carácter retroactivo y entrarán en vigor a partir de la fecha de su publicación. Si no acepta las condiciones modificadas de un Servicio, deberá dejar de usar dicho Servicio y solicitar la desactivación de su cuenta o Servicio.
En caso de conflicto entre estas condiciones y las condiciones adicionales, estas condiciones prevalecerán sobre las condiciones adicionales. Estas condiciones rigen la relación entre wstudio.app y el Usuario, y no generan ningún derecho del que pueda ser beneficiario un tercero.
Si no cumple estas condiciones y wstudio.app no toma ninguna medida al respecto de forma inmediata, no se entenderá que wstudio.app renuncia a los derechos de los que pueda disponer o llevar a cabo en el futuro.
La ilegalidad, ineficacia, invalidez o nulidad de una o varias de las estipulaciones del presente documento, declaradas por autoridad competente, no afectarán la validez, eficacia o legalidad de las restantes estipulaciones.
Cualquier litigio que se derive de estas condiciones o de los Servicios o que esté relacionado con los mismos, se regirá por las leyes de la República de Costa Rica, sometiéndose las partes a la jurisdicción exclusiva de los Tribunales del Primer Circuito Judicial de San José, Costa Rica, asumiendo a su vez cualquier gasto, honorario o costo en el que debe incurrir wstudio.app para estos efectos.

The products and services hereinafter referred to as the "Services" are provided through DESARROLLOS Y SISTEMAS MCG S.A., hereinafter referred to as "wstudio.app".
The use of our Services implies acceptance of these conditions. Please carefully read and review the Terms and Conditions of use and our Privacy Policy before using any wstudio.app Service. If you do not agree with these conditions, please do not continue using our Services.
wstudio.app provides various Services to natural and/or legal persons, hereinafter referred to as "User". "User" shall mean any person who uses the services or products of wstudio.app.
These conditions govern the access or use that Users make of the Services that wstudio.app makes available. By using the Services, you fully accept and undertake to fully comply with the Terms and Conditions of Use, as well as our Privacy Policy. wstudio.app reserves the right to modify these Terms and Conditions of Use whenever it deems necessary. Therefore, the User must carefully read the Terms and Conditions of Use each time they intend to use the Service, as these may be subject to modification.
These Terms and Conditions of Use shall apply to all wstudio.app brands, products and services that do not have independent terms and conditions of use. These Terms of Use are limited solely to wstudio.app and its Services. wstudio.app does not control and cannot control and/or guarantee the Terms of Use or the Privacy Policy of third parties, including providers and/or companies that may be accessed through our services.
The User agrees not to use the Services for fraudulent purposes nor to carry out any conduct that could damage the image, interests and rights of wstudio.app or of third parties. Likewise, the User agrees not to perform any action aimed at damaging, disabling or overloading any Service, performing reverse engineering or in any way preventing the normal use and operation of the Service.
The User is informed that, in the event of breach of the content of these terms of use and conditions, of the Privacy Policy or of any other particular terms or conditions established in the Services, wstudio.app reserves the right to limit, suspend, interrupt or terminate access to the Services. Likewise, wstudio.app reserves the possibility of exercising such measures if it reasonably suspects that the User is violating any of the aforementioned terms and conditions. Finally, we inform the User that wstudio.app reserves at all times the power to decide on the continuity of the Services it provides, and it is therefore wstudio.app's decision to maintain or terminate the Services.
wstudio.app is the provider of several Services, such as but not limited to providing a management tool for fitness and yoga studios and others, reservation management, messaging, clients, due dates, calendar. In those cases where the User has consented, the User may receive information and news from wstudio.app or related to health and sports through email, SMS or other electronic means of communication. You are reminded that by using the Service you are deemed to immediately accept the receipt of all kinds of commercial or advertising information from wstudio.app.
Some of our Services allow you to upload, send, store or receive content. If you do so, you will remain the owner of the intellectual property and/or personal rights you have over that content. However, on some occasions wstudio.app, its directors, subsidiaries, representatives, partners and/or collaborators may use, host, store, reproduce, modify, create, communicate, perform or display such content provided your consent is obtained. Make sure you have the necessary rights over any content you submit to our Services; if you use incomplete information or information that does not belong to you, it will be at your sole responsibility, so wstudio.app is not responsible for the information the User decides to include and/or any use given to it.
This clause applies only to studios that contract a wstudio.app product or Service.
The User must pay for the Service in advance, according to the plan they have selected and its specific characteristics. Payment periods are monthly only. The User is responsible for providing complete, up-to-date and accurate payment information along with their contact details, and for notifying wstudio.app of any change. The invoice will be sent automatically to the email address indicated by the User. By making the payment, the User accepts and authorizes the receipt and sending of the billing information corresponding to their service.
The payment methods accepted by wstudio.app are:
Credit or debit card payments are processed in U.S. dollars (USD). Payments made via SINPE Móvil or bank transfer may be made in Costa Rican colones (CRC) or in U.S. dollars (USD), depending on the bank account indicated by wstudio.app.
If the User makes the payment by transfer or SINPE Móvil, the payment must be made at least three (3) days prior to the billing date. In addition, the User must report the payment on the corresponding screen within the wstudio.app system. Simply making the transfer without reporting it is not enough; unreported payments will be considered not made.
If the payment is not reported, or is reported outside the established term, a $10 USD late-payment fee will be charged.
wstudio.app does not store information about the cards used to make payments. The data travels securely directly to the processing bank and is not saved on our servers.
wstudio.app's fees do not include taxes of any kind. The User is solely responsible for paying any tax associated with the purchase of the Service. wstudio.app is only responsible for taxes derived from its own income, property and employees.
wstudio.app reserves the right to suspend, block or terminate the Service if the User does not make the corresponding payment on the indicated date or does not properly report a transfer. Before suspension, wstudio.app will make reasonable efforts to notify the User through the platform. If payment is not regularized, wstudio.app is not responsible for the loss of information, since non-payment implies that the User does not wish to continue with the Services.
The service is paid monthly and in advance. wstudio.app does not issue refunds or returns of money, even for fractions of a period. If the User cancels or deactivates their account before the end of the period, they will retain access until the end of that period. It is recommended to carefully review the plan before making the payment.
Since the service is paid in monthly periods in advance, you are advised to review the type of plan you wish to acquire, in light of the fact that wstudio.app does not make refunds or returns of money. wstudio.app also does not make refunds for fractions of the payment period for use of the Service. If the User deactivates or cancels their account before the end of the payment period, the User will retain access to their account for the remainder of the period for which they had paid.
wstudio.app is constantly changing and improving its Services. For this reason, we may add or remove some features, services or characteristics, or we may suspend or cancel a Service entirely.
You may stop using the Services at any time, although we would regret it. Likewise, wstudio.app may stop providing the Services or add or create new limitations at any time, without this giving rise to any liability for wstudio.app.
We consider that you are the owner of your data and that it is important for you to retain access to it. If we delete and/or interrupt a Service, in reasonable cases, we will notify you five calendar days in advance and will allow you to obtain the information within the Service through the use of existing reports. Once the aforementioned term has elapsed, wstudio.app may delete or block the information. Failure to respond to the communication sent by wstudio.app will be understood as a lack of interest and express consent to delete the information.
Personal data shall be provided to wstudio.app by the User. wstudio.app will not transfer personal data to third parties in any way, unless it has obtained your consent or when required by law. However, it may use personal data for internal purposes, including audits, data analysis and research, in order to improve products, services and communications to wstudio.app users. Such use will however be dissociated.
wstudio.app may use non-personal information for its own research and statistics, and may share and/or sell this information to third parties or use it for marketing or commercial prospecting purposes. The User accepts that we may provide non-identifiable information to any organization with which wstudio.app maintains any kind of relationship, provided this information is dissociated and does not identify any User.
Consolidated data is considered non-personal data. If we combine non-personal data with personal data, the combined data will be treated as personal data as long as it remains combined.
The User is responsible for maintaining the confidentiality of the password and any other information of their access account. The User is responsible for the use given to the Service by sharing all or part of their information with any third party. Likewise, it is the User's responsibility to share with third parties their login user and/or password that may give them access to, alter or delete the information stored in the Service. Likewise, it shall be the User's exclusive responsibility to periodically back up the information entered and saved in any Service, since in the event of malfunction due to causes external to wstudio.app or misuse of the computer and/or application, the information may disappear. wstudio.app must be notified immediately at wstudio.app@gmail.com if a User considers that security measures have been compromised or their account has been breached and/or altered.
Despite all the disclaimers under this document, the sole and exclusive remedy for any dispute with wstudio.app is the cancellation of the registration or termination of the Service. In no case shall wstudio.app be liable to the User for an amount in excess of $100 for all claims and demands of any nature, type and/or extension, whether actual or contingent, direct and punitive, including attorneys' fees and costs. Furthermore, in no case shall wstudio.app be liable for any loss, expenses, travel, lodging expenses, injuries, aggravations of physical and mental conditions, death, loss of information, damage to image, or any other event caused in whole or in part by a failure of a Provider or of the Service provided by wstudio.app.
wstudio.app is not responsible for damages caused to the User as a consequence of risks inherent in the medium used, nor for those caused by vulnerabilities in its systems and tools. wstudio.app does not guarantee the total security of its systems either, and although it has adopted adequate security measures, the existence of vulnerabilities cannot be totally ruled out and, consequently, the User must be cautious in the interaction and use of the Services.
wstudio.app will only be liable, up to the amount indicated in point 8 of this document, for damages caused by the use and functionality of the Services, when such damages are directly caused by willful misconduct or gross negligence of wstudio.app, and there has been no negligence on the part of the User such as but not limited to: providing and/or sharing their password and/or any kind of information. In particular, wstudio.app will not be responsible for:
wstudio.app makes its best effort to protect your personal information; however, the User is responsible for making backup copies, on their own computer or another device, of any document, image or other important content they save or access through the Services provided by wstudio.app. wstudio.app will make its best effort to provide the Services, but does not give any guarantee that the content saved or accessed through the Services may not be inadvertently damaged, lost or corrupted.
The User expressly acknowledges and accepts that the use they make of the Services is at their own risk, and the User will therefore be solely responsible for any damage caused to their device or for the loss of data resulting from downloading such material. The User further acknowledges that the Services are not intended or suitable for use in situations or environments in which the use of the Service could entail death, personal or property damages, serious physical injuries or significant environmental damage.
In the event that wstudio.app reasonably determines or suspects that a User has violated or could violate the privacy policies, conditions or any agreement, it may, but is not obligated to, without prior notice, immediately interrupt and/or suspend the registration or use of a User. wstudio.app may from time to time cancel accounts due to prolonged inactivity; in such circumstance, wstudio.app will reasonably endeavor to give notice to the email address on our records. In no case shall wstudio.app be obligated to take action to suspend or cancel.
Likewise, if you wish to deactivate your account, please contact us. Once your request is made, your account will be deactivated and your personal information will be archived or destroyed as required by law. wstudio.app may retain your information for the period required by law to comply with legal obligations, resolve disputes and agreements or any other required in accordance with these terms and conditions and applicable law.
Except in the case of duly proven gross negligence or intentional misconduct of wstudio.app, the User agrees to indemnify and defend wstudio.app, together with its officers, directors, employees, agents, representatives, affiliated or subsidiary companies, and contractors, against all liabilities, claims, demands and expenses, including reasonable attorneys' fees and expenses, made by any third party arising out of or related to the User's access to the Services, and/or violation of the privacy policies and the terms and conditions of use.
wstudio.app, in accordance with the Law on the Protection of the Person against the Treatment of their Personal Data, Law 8968 and its Regulations, hereinafter identified as "the Law", we inform you of the existence of the database called "Users", whose responsible for the use, administration and protection of your personal data is wstudio.app, which is why wstudio.app will permanently seek to ensure that the treatment of your personal data is legitimate, controlled and informed, with the aim of guaranteeing the privacy and right to informational self-determination of your data.
The personal data that we collect from you, hereinafter identified as The User, through electronic, physical or telephone means, verbally and/or in writing, we will use for the following necessary purposes:
It is important to note that wstudio.app is not responsible for the truthfulness or accuracy of the personal data you provide, since these have not been previously validated and/or verified, so the inclusion, updating, truthfulness and accuracy of your personal data are your responsibility. The provision of information is optional; however, the falsity or omission of any data will mean the impossibility of providing the service correctly.
wstudio.app will implement the technical, administrative and physical security measures necessary to protect the integrity of your personal data and avoid its damage, loss, alteration, destruction or unauthorized use, access or treatment. Only the companies and personnel authorized by wstudio.app and/or any of the companies that are part of the economic interest group, that have complied with and observed the corresponding confidentiality requirements, may participate in the treatment of your personal data. Authorized personnel are prohibited from allowing access to unauthorized persons and from using your personal data for purposes other than those established in this document.
You may revoke the consent given for the treatment of your personal data. However, it is important to bear in mind that we will not be able in every case to attend to your request or end the use immediately, since due to some legal obligation it may be necessary to continue treating your personal data. Likewise, you must consider that for certain purposes, the revocation of your consent will imply the conclusion of the attention and/or services provided.
We remind you of the possibility to know free of charge what personal data you have provided us, as well as to request the correction, updating, cancellation or suppression (ARCO rights) of your information under the terms established by Law, by sending a written communication to the following address: wstudio.app@gmail.com, indicating name and surnames, address, clear request of your right, date and signature of the interested party.
wstudio.app offers optional integrations with third-party services, such as Zoom, to complement the functionality offered to the User. The use of these integrations is voluntary and requires the express authorization of the User through the corresponding connection flow within the application.
By activating an integration, the User accepts that wstudio.app accesses only the information strictly necessary to provide the described functionality, and that such information is stored securely and associated exclusively with the studio that performs the connection. wstudio.app does not share this information with third parties nor does it use it for purposes other than those described.
The User may deactivate any integration at any time from the studio's settings or from the platform of the corresponding third-party service. Upon deactivation, wstudio.app will revoke the associated credentials and will stop using such service. wstudio.app is not responsible for the operation, availability or changes in the terms of the third-party service, which are governed by their own policies and conditions.
wstudio.app may modify these conditions or any additional conditions that apply to a Service. We recommend that you consult the terms and conditions of use periodically. wstudio.app will publish notices related to modifications of these conditions. Likewise, it will publish notices related to modifications made to the additional conditions of the corresponding Services. The modifications will not be applied retroactively and will enter into force from the date of their publication. If you do not accept the modified conditions of a Service, you must stop using such Service and request the deactivation of your account or Service.
In the event of conflict between these conditions and the additional conditions, these conditions shall prevail over the additional conditions. These conditions govern the relationship between wstudio.app and the User, and do not generate any right of which a third party may be a beneficiary.
If you do not comply with these conditions and wstudio.app does not take any immediate action in this regard, it will not be understood that wstudio.app waives the rights it may have or carry out in the future.
The illegality, ineffectiveness, invalidity or nullity of one or several of the stipulations of this document, declared by a competent authority, will not affect the validity, effectiveness or legality of the remaining stipulations.
Any litigation arising from these conditions or from the Services or related to them shall be governed by the laws of the Republic of Costa Rica, with the parties submitting to the exclusive jurisdiction of the Courts of the First Judicial Circuit of San José, Costa Rica, assuming in turn any expense, fee or cost that wstudio.app must incur for these purposes.
